NSW: Rivkin loses defamation battle against Fairfax

Flamboyant stockbroker RENE RIVKIN has lost his defamation battle against the John
Fairfax Press group.

The case centred on three articles which allegedly implied RIVKIN had sex with his
male chauffeur and had arranged the death of a Sydney model.

Before being whisked away from the New South Wales Supreme Court, Mr RIVKIN said he
was flabbergasted by today's decision.

The financier had sued over the articles -- two in The Sydney Morning Herald and one
in the Australian Financial Review -- which appeared after a 1998 inquest into the death
of model CAROLINE BYRNE.

After 50 minutes, the four-woman jury threw out 17 defamatory meanings alleged to have
arisen from the articles.

They were published after Coroner JOHN ABERNETHY was unable to determine how Ms BYRNE,
24, had died.

Ms BYRNE'S body was found at the bottom of The Gap, a well-known suicide spot in Sydney's
east, on June 7, 1995.

The coroner found Ms BYRNE either slipped, was pushed, or had jumped.

Mr RIVKIN, speaking outside the court, said he had not ruled out an appeal.

Justice CAROLYN SIMPSON awarded all legal costs against Mr RIVKIN.
